Cherry Hoggs Waiver & Release Agreement

By signing this agreement, I (hereinafter referred to as “Owner”) represent that I am the legal owner or custodian of the above-named dog(s). I acknowledge and accept all risks associated with my dog(s) attending daycare, boarding, off-leash activities, or training services provided by Cherry Hoggs.

1. Assumption of Risk & Owner Responsibility

Owner understands and agrees that Cherry Hoggs and its staff will take all reasonable precautions to ensure the safety and well-being of all dogs in their care. However, Owner accepts and assumes all risks and responsibility for any harm, injury, illness, loss, or damage caused by or to their dog(s) while participating in any Cherry Hoggs services, including but not limited to daycare, boarding, training, transportation, or off-leash activities.

2. Photo and Video Release

Owner grants Cherry Hoggs permission to photograph, video, and otherwise record both their dog(s) and themselves while on the premises or participating in Cherry Hoggs activities, including training sessions, drop-offs, pack walks, and events. These recordings may be used in any media, at any time, for promotional, advertising, educational, or commercial purposes. Owner waives any right to inspect or approve such materials and releases Cherry Hoggs from any related claims.

If Owner does not wish for themselves or their dog(s) to appear in any media, they must notify Cherry Hoggs in writing before attending.

3. Health and Vaccination Requirements

Owner affirms that their dog(s) is/are in good health, free of contagious diseases, and up-to-date on vaccinations, including rabies. Owner agrees not to bring any dog that has exhibited signs of illness or has had a contagious condition within the last 30 days. Owner acknowledges that vaccines (including Bordetella) do not guarantee immunity and agrees not to hold Cherry Hoggs responsible if their dog contracts kennel cough or any other communicable illness.

4. Group Play and Behavior

Owner certifies that they have disclosed any known history of aggression, reactivity, or behavioral issues their dog(s) may have toward people or other dogs. Cherry Hoggs works with dogs of all temperaments, including those undergoing behavior modification or aggression rehabilitation. However, for the safety of all dogs and staff, Cherry Hoggs reserves the right to separate, muzzle, or remove any dog from group activities if their behavior is deemed unsafe or unmanageable.

Failure to disclose known behavioral issues may result in the dog’s removal from the program and the Owner accepting full liability for any resulting injury or damage.

5. Consent to Training and Behavioral Methods

Owner acknowledges and agrees that Cherry Hoggs employs a structured training and behavioral methodology, including but not limited to techniques such as temporary removal from the group and crate time when necessary. These methods are used to reinforce appropriate behavior and ensure the safety and emotional balance of all dogs in the Cherry Hoggs environment. In some cases, a dog may be temporarily placed in a secure crate away from the group as part of this process. Owner understands that during this time, the dog may not be under continuous direct supervision but will be safely contained and monitored as appropriate. By enrolling their dog(s) in Cherry Hoggs services, Owner grants permission for Cherry Hoggs staff to apply these methods at their discretion, as part of the Cherry Hoggs philosophy and pack-based training model.

6. Release of Liability

Owner understands and accepts that during normal dog play or training, injuries such as scratches, punctures, and sprains can occur. Cherry Hoggs staff closely supervise all dogs but cannot be held responsible for injuries, illness, escape, or death provided Cherry Hoggs has acted with reasonable care and in good faith. Owner hereby releases Cherry Hoggs, its employees, volunteers, and contractors from all liability, claims, or damages of any kind arising from their dog(s)’ participation in Cherry Hoggs services.

7. Staff Injury Clause

If Owner’s dog(s) injures a Cherry Hoggs staff member, contractor, or volunteer — including through biting or other aggressive behavior — and medical attention is required, Owner agrees that they will be financially responsible for resulting medical expenses. This includes, but is not limited to, hospital visits, medication, physical therapy, or related treatment costs.

8. Off-Leash Pack Walks

Owner consents to their dog(s) participating in off-leash pack walks in public parks or trails. Owner accepts all risks associated with off-leash activities and agrees not to hold Cherry Hoggs liable for any loss, illness, injury, or death occurring during such activities.

9. Transportation

Owner acknowledges that transportation of animals carries inherent risks. Cherry Hoggs will take reasonable care but assumes no liability for injury, illness, stress, loss, or death arising during or due to transportation. Owner accepts all risks and waives all claims related to use of Cherry Hoggs transportation services.

10. Payment Terms

Payment is due at the start of each week (Monday) for all services. Payments must be made via PayPal unless otherwise arranged in writing.

11. Cancellation and No-Show Policy

Any changes or cancellations must be made before 8am on Monday. Changes made after this time will be charged in full.

12. Hours of Operation and Late Fees

Dogs may be dropped off no earlier than 8am and must be picked up by 5pm. A late fee of $10 per 30 minutes will be applied for any late pickups.

13. Emergency Medical Care

In the event of an emergency, Cherry Hoggs will make every reasonable effort to contact the Owner. If the Owner cannot be reached promptly, Cherry Hoggs is authorized to seek veterinary care for the dog(s) at the Owner’s expense. Owner agrees to reimburse Cherry Hoggs for any medical expenses incurred.

14. Compliance with Safety Instructions

Owner agrees to follow all safety-related instructions provided by Cherry Hoggs staff. This includes, but is not limited to, the requirement to bring and/or place a muzzle on their dog if instructed to do so. Failure to comply with such instructions may result in removal from Cherry Hoggs services, and Owner accepts full liability for any resulting injury or damage caused by their dog as a result of non-compliance.

15. Indemnification

Owner agrees to indemnify, defend, and hold harmless Cherry Hoggs, its employees, volunteers, agents, and contractors from any and all claims, losses, liabilities, damages, expenses, and costs (including reasonable attorney’s fees) arising out of or relating to the actions of their dog(s), their own conduct, or any breach of this agreement.

16. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of Minnesota. Any disputes arising out of this agreement shall be resolved in the courts located in Minnesota.
